1. Agreement to Terms

Welcome to bmw365. By accessing, browsing, or using the bmw365 website, mobile applications, or any related services (collectively, the "Services"), you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions (the "Terms"). These Terms constitute a legally binding agreement between you (the "User" or "Player") and bmw365 (the "Company," "we," "us," or "our").

• Single Account: You are permitted to hold only one (1) account with bmw365. Creation of multiple accounts is strictly prohibited and may result in the suspension or closure of all associated accounts and forfeiture of funds.
• Personal Use: Your bmw365 account is for your personal, non-commercial use only. You may not use the Services on behalf of any third party or for any commercial, professional, or business purposes.

3. Account Registration and Security

3.1 Registration Process

To access bmw365 Services, you must complete the registration process by providing accurate, current, and complete information as prompted by our registration form. Required information includes but is not limited to your full legal name, date of birth, residential address, valid email address, and mobile phone number. You agree to maintain and promptly update your account information to keep it accurate and current.

3.2 Account Security

You are solely responsible for maintaining the confidentiality of your account credentials, including your username and password. You must not share your login information with any third party. You agree to immediately notify bmw365 of any unauthorized use of your account or any other breach of security. bmw365 will not be liable for any losses arising from unauthorized use of your account, whether with or without your knowledge.

You are responsible for all activities that occur under your account, whether authorized by you or not. We strongly recommend that you choose a strong password combining letters, numbers, and special characters, and that you enable two-factor authentication when available.

3.3 Verification Requirements

bmw365 reserves the right to request verification documents at any time to confirm your identity, age, payment methods, and residential address. Such documents may include government-issued photo identification, proof of address (utility bill, bank statement), and copies or photos of payment instruments used for deposits. You agree to provide all requested documentation within the timeframe specified by bmw365. Failure to provide verification documents may result in account suspension and withdrawal restrictions until verification is completed.

4. Deposits and Withdrawals

4.1 Deposits

bmw365 accepts deposits via various payment methods available to Filipino players, including but not limited to GCash, PayMaya, bank transfers, and other methods displayed on our platform. All deposits must be made in Philippine Pesos (PHP) or other currencies supported by bmw365. You may only use payment methods registered in your own name. Third-party deposits are strictly prohibited and will result in funds being returned and potential account suspension.

All deposits are subject to minimum and maximum limits as displayed on the platform. bmw365 does not charge fees for deposits; however, your payment provider may impose transaction fees. Deposit funds are typically credited to your account instantly, though processing times may vary depending on the payment method used.

4.2 Withdrawals

You may request withdrawal of your account balance at any time, subject to these Terms and any applicable bonus terms. Withdrawals must be made to the same payment method and account used for deposits, unless otherwise approved by bmw365 for security or technical reasons. We reserve the right to request additional verification before processing withdrawal requests.

Withdrawal requests are typically processed within fifteen (15) minutes for GCash and PayMaya, though processing times may vary. Minimum withdrawal amounts apply as displayed on the platform. bmw365 reserves the right to decline a withdrawal request if there are reasonable grounds to believe the funds are proceeds from fraudulent or illegal activity.

4.3 Anti-Money Laundering

bmw365 is committed to preventing money laundering and terrorist financing. We employ strict anti-money laundering (AML) policies and procedures in compliance with applicable Philippine laws and regulations. Suspicious transactions or activity may be reported to relevant authorities. You agree that bmw365 may conduct enhanced due diligence and request additional documentation if transactions appear inconsistent with normal gaming patterns.

5. Betting Rules and Game Play

5.1 General Betting Rules

All bets placed on bmw365 are governed by the specific rules applicable to each game type, which are available on our platform. For casino games, the relevant game rules are accessible within each game interface. For sports betting, our general sports betting rules and sport-specific rules apply. In the event of a conflict between these Terms and specific game rules, the specific game rules shall prevail.

Once a bet is placed and confirmed, it cannot be cancelled, altered, or withdrawn by the Player. bmw365 reserves the right to void bets in cases of obvious error, technical malfunction, or where we have reasonable grounds to believe the bet was placed fraudulently or in breach of these Terms.

5.2 Game Results and Settlement

For casino games, outcomes are determined by certified random number generators (RNG) that ensure fair and unpredictable results. For sports betting, settlement is based on official results as determined by the relevant governing body or organization. bmw365's decisions regarding bet settlement are final and binding, unless there is clear evidence of an error.

5.3 Prohibited Activities

The following activities are strictly prohibited and constitute material breaches of these Terms:

• Use of automated betting systems, bots, or any software designed to place bets on your behalf
• Collusion with other players or third parties
• Exploitation of software vulnerabilities, errors, or loopholes
• Arbitrage betting or "bonus abuse" designed to guarantee profits
• Money laundering or use of bmw365 Services for any illegal purpose
• Abusive, threatening, or harassing behavior toward bmw365 staff or other players

Violation of these prohibitions may result in immediate account closure, forfeiture of funds, and reporting to relevant authorities.

6. Bonuses and Promotions

bmw365 offers various bonuses, promotions, and loyalty rewards to our players. All bonuses are subject to specific terms and conditions ("Bonus Terms") that must be satisfied before bonus funds or winnings derived from bonus funds can be withdrawn. Bonus Terms include but are not limited to wagering requirements, eligible games, maximum bet limits, time restrictions, and withdrawal restrictions.

It is your responsibility to read and understand the Bonus Terms applicable to each promotion before opting in. 7. Intellectual Property

You are granted a limited, non-exclusive, non-transferable license to access and use the bmw365 Services for personal, non-commercial purposes only. You may not reproduce, distribute, modify, create derivative works from, publicly display, publicly perform, republish, download, store, or transmit any Content from bmw365 except as explicitly permitted by these Terms.

The bmw365 name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of bmw365 or its affiliates. You may not use such marks without our prior written permission. All other names, logos, product and service names, designs, and slogans on this platform are the trademarks of their respective owners.

8. Limitation of Liability

To the maximum extent permitted by applicable law, bmw365 shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:

• Your access to or use of (or inability to access or use) the Services
• Any conduct or content of any third party on the Services
• Any content obtained from the Services
• Unauthorized access, use, or alteration of your transmissions or content
• Technical failures, interruptions, or errors in service provision

bmw365 provides the Services on an "as is" and "as available" basis. We make no warranties, express or implied, regarding the Services, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance. bmw365 does not warrant that the Services will be uninterrupted, secure, or error-free, or that any defects will be corrected.

In no event shall bmw365's total liability to you for all damages, losses, and causes of action exceed the amount you have paid to bmw365 in the six (6) months preceding the claim, or One Thousand Philippine Pesos (PHP 1,000), whichever is greater.

9. Account Termination

9.1 Termination by Player

You may close your bmw365 account at any time by contacting our customer support team. Upon account closure, you must withdraw any remaining balance in your account. bmw365 is not responsible for any funds left in closed accounts.

9.2 Termination by bmw365

bmw365 reserves the right to suspend or permanently close your account at any time, with or without notice, for any reason, including but not limited to:

• Breach of these Terms or any applicable laws or regulations
• Provision of false or misleading information during registration or verification
• Fraudulent, illegal, or suspicious activity
• Abusive behavio r toward bmw365 staff or other players
• Failure to provide requested verification documents
• Request from regulatory or law enforcement authorities
• Extended period of account inactivity

Upon termination, bmw365 will return any remaining account balance to you after deducting any amounts owed to bmw365, provided the termination was not due to fraudulent or illegal activity. In cases of fraud, bmw365 reserves the right to retain all funds in the account.

10. Dispute Resolution

In the event of any dispute, claim, or controversy arising out of or relating to these Terms or your use of bmw365 Services (a "Dispute"), you agree to first attempt to resolve the matter informally by contacting our customer support team. We are committed to working with you in good faith to reach a mutually satisfactory resolution.

If a Dispute cannot be resolved through informal negotiation within thirty (30) days, the Dispute shall be resolved through binding arbitration in accordance with the rules of arbitration applicable in the Philippines. The arbitration shall be conducted in English and shall take place in Metro Manila, Philippines. The decision of the arbitrator shall be final and binding on both parties.

These Terms and any Disputes shall be governed by and construed in accordance with the laws of the Republic of the Philippines, without regard to conflict of law principles. You agree to submit to the exclusive jurisdiction of the courts located in Metro Manila, Philippines for resolution of any legal matters not subject to arbitration.

Class Action Waiver

You agree that any arbitration or legal proceeding shall be conducted on an individual basis and not as a class action, consolidated action, or representative action. You expressly waive your right to participate in any class action lawsuit or class-wide arbitration against bmw365.

11. General Provisions

11.1 Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it valid and enforceable. If such modification is not possible, the invalid provision shall be severed from these Terms, and the remaining provisions shall continue in full force and effect.

11.2 Waiver

No waiver by bmw365 of any term or condition set forth in these Terms shall be deemed a further or continuing waiver of such term or condition, and any failure by bmw365 to assert a right or provision under these Terms shall not constitute a waiver of such right or provision.

11.3 Assignment

You may not assign or transfer these Terms or your account to any third party without bmw365's prior written consent. bmw365 may assign or transfer these Terms and your account to any affiliate, subsidiary, or successor entity without restriction and without notice to you.

11.4 Entire Agreement

These Terms, together with our Privacy Policy and any specific rules or terms applicable to particular Services or promotions, constitute the entire agreement between you and bmw365 regarding your use of the Services and supersede all prior agreements, understandings, and communications, whether written or oral, between you and bmw365.
